New Section 179D/179F Legislation

Work is underway on a Section 179D reform package in the Senate. Senators Bingaman and Snowe are developing a bipartisan package. The package modifies aspects of Section 179D and also proposes a new Section 179F, which is a performance-based energy efficiency deduction aimed at addressing the issue of building falling short of efficiency goals and the issue of retrofits.
The package also extends the policy for an additional 5 years.
The staff in both Congress and Senate have been soliciting stakeholder input and are incorporating feedback into the draft. We expect introduction into senate in the very near-term.
I’ll keep you posted as our Law Firm in Washington DC makes further updates.
