Effectively Handling OSHA’s New National Emphasis Program Targeting Restaurants

On March 12, 2021, OSHA issued a new National Emphasis Program (NEP) for COVID-19, targeting specific high-hazard industries. The NEP includes an added focus on workers at serious risk, and on employers that engage in retaliation against employees who complain about unsafe conditions or for exercising other rights protected by federal law. In the primary target industries list, OSHA identified full-service restaurants and limited service restaurants for targeted inspections. All restaurants may be subject to an OSHA inspection under this NEP, and can anticipate that OSHA will become much more aggressive about inspections and issuing citations with large penalties.
